Terms of Service

By using fundingforsellers.com (the “Site”), you agree to these terms. If you're using the Site on behalf of a business, you represent that you have authority to bind that business.

What we are — and are not

FFS is a matching and introduction platform. We collect information about your business and funding needs, evaluate it against lending partners' stated criteria, and — with your approval — introduce you to lenders. We are not a lender, bank, or credit provider. We do not make credit decisions, issue commitments, or guarantee that any lender will offer you financing or particular terms. All funding decisions are made solely by lenders under their own agreements with you.

Nothing on the Site is financial, legal, tax, or investment advice. Content describing funding structures is general education; whether any structure fits your business is a decision for you and your advisors.

How we're paid

Lending partners typically pay us referral or partnership fees when financing closes or for platform services. This does not increase the price you pay a lender. We do not accept compensation to present merchant cash advance products, which we exclude from the platform as a matter of policy.

Your account and information

• You agree that information you submit is accurate and that you're authorized to share it. Lenders rely on it; inaccurate submissions can end an introduction — or a funding agreement — badly.
• Sign-in links are personal. You're responsible for activity under your account and for keeping your email account secure.
• You may request deletion of your account and data at any time via hello@fundingforsellers.com.

Introductions and third parties

When you approve an introduction, we share your profile with that lender and they may contact you directly. Your dealings with any lender — including diligence, agreements, rates, and performance — are between you and them. We work with partners we vet, but we are not a party to your financing agreements and are not responsible for lenders' acts, omissions, or decisions. Data-connection permissions you grant to lenders are governed by our Privacy Policy and are revocable at any time.

Acceptable use

Don't misuse the Site: no false identities or submissions on behalf of businesses you don't represent, no scraping or automated access, no attempts to probe or breach security, no use that violates law. We may suspend or terminate access for violations.

Intellectual property

The Site, its content, and the FundingForSellers name and logo are our property or used with permission. You may not copy or reuse them except as needed to use the Site normally.

Disclaimers and limitation of liability

THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MATCHES WILL BE AVAILABLE, THAT INTRODUCTIONS WILL RESULT IN FINANCING, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHMUTZ ART LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY INTRODUCTION MADE THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER.

Indemnity

You'll indemnify us against claims arising from your breach of these terms or your misuse of the Site, including submission of information you weren't authorized to share.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction. If any provision is unenforceable, the rest remain in effect.

Changes

We may update these terms as the product evolves; the effective date above will change and continued use constitutes acceptance. Material changes will be flagged on the Site or by email.
